Divorcing of a Same-Sex Relationship Before the Legalization of Same-Sex Marriage

From The San Antonio Current: In Texas, a San Antonio man has filed for a divorce in which he seeks to prove a common law marriage existed with his former partner of 25 years when same sex marriage was prohibited under the law. In 2015. the law was ruled unconstitutional. This case could set precedent in Texas because this is going to be the first time that a common law, or informal, divorce would be granted to a same sex couple who were together prior to Obergefell.

Hoffman, the party seeking divorce, cited adultery and mistreatment. 

Ortiz, the party in response to the divorce, argued that a common law marriage did not exist, saying that they had only been roommates. By finding that the claim of "roommates" to be "incredulous testimony," Judge Mary Lou Alvarez issued a temporary order granting a $1,200 monthly interim spousal support to Hoffman. Thereafter Ortiz filed a motion for a Declaratory Judgment.
